CONTENT: All services may be used for lawful purposes only.
Transmission, storage, or presentation of any information, data or
material in violation of Australian Federal and State Law is prohibited.
This includes, but is not limited to: copyrighted material, material we
judge to be threatening or obscene, or material protected by trade secret
and other statute. Dibella Web Hosting will be held unaccountable for any
damages that is incurred by a subscriber or any other party
Note: There must be no attachment to our webservers linking back to any
sought of pornography of any type.
TRAFFIC GUIDELINES: All accounts are limited to a particular 'Bandwidth'
limit (as noted in the plan information); Should a site use more than it's
provided bandwidth the site is automatically suspended until the matter is
resolved.
If you do not wish to upgrade your plan within the month you can 'wait
out' the remaining days of your month until your limit is reset to the
full amount in your next billing month.
CGI-SCRIPTS: You are free to use any CGI scripts you wish, however, we
reserve the right to disable any CGI script that effects normal server
operation.
CHAT ROOMS: We do not allow clients to install their own chat rooms. These
tend to be large system hogs and we cannot allow it as an account option.
However, we do provide a choice of Java and PHPchat rooms that will more
than fill your needs and run without hindering the performance of the
machine for others. But please limit the chatrooms to one to a domain.
BACKGROUND RUNNING PROGRAMS: We may allow programs to run continually in
the background. These are considered on a user to user case basis and an
extra charge will be incurred based on system resources used and
operational maintenance needed.
E-MAIL SPAMMING: Di Bella Web Hosting will not tolerate any form of
spamming and in turn will terminate the hosting account. And then contact
the proper authorities.
SERVER ABUSE: Any attempts to undermine or cause harm to a server is
strictly prohibited.
REFUSAL OF SERVICE: We reserve the right to refuse or cancel service at
our sole discretion.
Failure to comply with with any of our policies will result in immediate
termination of services. No refunds will be issued under these
circumstances.
UPTIME:
If any server uptime falls below 99.8%(1hr and 26 mins)on a monthly basis due to:
1) Unscheduled downtime
2) Server downtime
3) Network downtime; the following rules apply.
* For every 30 minutes of downtime to the server there will be a 5% refund available for that month
* Maximum payout for a month is upto and including a 100% refund for that month
The above rules do not apply in the following instances:
1) Notified Scheduled Downtime
2) Internet-Wide Vulnerabilities- (ie. Ddos)
3) Hardware failures -(All measures are taken to make sure that there will be no Hardware failures)
To claim a refund all you need to do is email us stating that you wish to make a claim against our TOS. Stating your domain name and the period of time for which your site was unreachable. Once the downtime of your domain name has been confirmed we will issue a refund.
REFUND POLICY & ACCOUNT CANCELLATION:
If for some reason, the client is not happy with their service, it may BE cancelled at any time within 14 days from the beginning of their account for a full refund.
However if after 14 days the client decides to close their account with us it is required for that the client to notify us 7 days prior to the end of their current billing period. This will give us enough time to delete your account from our billing system and making sure no more invoices will be issured to you.
The following avenues are ways to notify us of a Refund or Account cancellation:
1) Email Billing@dibellawebhosting.com
2) Log a ticket through the Help Desk
3) Through the Live Help interface
After 2 days of the account termination date, we will delete all client account details from our servers. In this case we strongly advise that the client back up their site via the control panel and download it to their local computer prior to advising us of the cancellation notice. This will make sure that no data is lost during transit.
No refunds will be issued in cases where we have terminated an account due to a breach of our TOS.
